The following terms and conditions govern all quotations and prices offered by GABIONPROS.com a wholly owned subsidiary of LWECO Group LLC (Seller) for its products and materials, whether made pursuant to oral or written orders, and shall control all matters dealings between “Seller” and “Buyer”
SELLER’S DISCLAIMER: Seller’s sale of products are for materials only and does not include any services such as design, engineering, material take offs or any other service that Buyer may require. The information contained in Sellers’s quotes including any attachments is accurate to the best of Seller’s knowledge. Seller disclaims all warranties, expressed or implied as to the mechantability or fitness of its products for a particular purpose. Buyer is responsible for verification of project design, material quantities or dimensions. Seller is not responsible for any discrepancies or omissions and actual material prices are subject to change if specifications, quantities or dimensions differ from Seller’s quote. Seller assumes no liability for the use of this information by the purchaser or ultimate end user (Buyer). Buyer assumes sole responsibility for the project design, installation, material quantities, suitability and actual use of products offered for sale by Seller. Material unloading, site logistics and personal safety are also the responsibility of the Buyer.
LIABILITY: Seller, its officers, directors, shareholders or properties shall not be responsible, obligated or liable for any injury by damage resulting from incorrect assembly, application or use of its products, either singly or in combination with other products arising out of acceptance of Buyer’s orders. In no event shall Seller be liable for any incidental, indirect or consequential damages arising from the use or inability to use Seller’s products and for any manufacturer’s defects, performance, inaccuracies or design issues that may cause delays. Seller also assumes no liability for the accuracy of specifications, material quantities and is reliant on the Buyer to perform their own evaluation, material take-offs to establish accurate quantities.
MATERIAL TAKEOFFS: Seller is providing unit pricing for gabion materials outlined in this proposal. Seller will assist Buyer with estimates of gabion sizes and quantities required for a project, but Buyer is responsible for verifying all quantities, material counts, measurements, and dimensions shown in Buyer’s drawings and specifications. In addition, Seller assumes no liability for errors or omissions in the quantities provided by the Buyer, Buyer’s estimator, or in the bidding documents. We will not be responsible for material shortages or surpluses based on these estimates.
TAXES and IMPORT / EXPORT LICENSES: Prices for equipment and materials as quoted, do not include any local, state or federal taxes, export crating or duties. Any applicable taxes and/or duties shall be paid by Buyer.
ORDER CANCELLATION & PRODUCT RETURNS: All gabion products are made to order and cannot be returned once orders are accepted and put into production. Orders cannot be canceled except upon the written approval of Seller. Stock items if approved for return must be returned in a new, resalable condition and after a return authorization (RA) has been issued by Seller. Buyer must prepay shipping charges and a 25% restocking charge may apply. Special orders are non-cancelable and non-refundable
SHIPPING CHARGES: Most large order deliveries come via 18 wheeler trailer type trucks. Domestic shipping charges are calculated based on the freight class, weight and dimensions of the shipment and receiving location (zip code). In addition to your zip code, we will need to know if the delivery address is a residence or business. Most shipments go by common carrier freight lines including FEDEX and UPS freight. Small orders (up to75 lbs.) are usually shipped via FEDEX or UPS package delivery service. Expedited or next day deliveries can be arranged at an additional cost to Buyer.
RESIDENTIAL DELIVERIES: If your order is shipping via a common carrier freight company to a residential address, carrier will deliver materials via an 18 wheeler type truck equipped with a hydraulic lift gate. Buyer will be contacted prior to delivery to arrange time and place for unloading. The carrier will require that someone is available to receive and sign for shipment, so when you schedule the delivery appointment, make sure you select a day that works for you. ALTERNATE DELIVERY OPTIONS: If the road or street is inaccessible by a large truck when the delivery is attempted, the delivery may have to be rescheduled with a smaller truck or the load picked up by the Buyer at a local terminal. Carriers apply an add-on charge for this service.
NOTE: ADDITIONAL SHIPPING CHARGES WILL APPLY IF …
* Scheduled business delivery location turns out to be a residence
* Residential deliveries require a lift gate to unload materials - maximum load size is 6 ft
* Delivery is returned to terminal and shipment re-scheduled
* Shipment re-routed to a different location
DAMAGED SHIPMENTS: Seller ships all materials F.O.B factory direct from shipping points and contracts with various carriers to deliver its materials in the same new condition as when it left its supplier's facilities.
BUYERS RESPONSIBILITY: It is Buyer’s responsibility to thoroughly inspect all items for shipping damage before accepting delivery. If damage has occurred while in transit, Buyer should document the extent of the damage on the freight bill and immediately notify Seller and the carrier. Seller's responsibility for loss and damage ceases when the carrier accepts the products for shipment, Buyer is also responsible for filing a damage claim with the carrier.
